SabaCall.com") provision of telephony services (the "Services") and sets out the basic rights, obligations and limitations of
SabaCall.com to its customers (the "Subscriber"). All of the terms and conditions contained herein (hereinafter referred to as "Terms") bind both
SabaCall.com and the Subscriber and are subject to change from time to time at the sole discretion of
SabaCall.com, without any prior notice to the Subscriber.
This is our agreement with you, the Subscriber. You agree not to use our Service for an illegal purpose, violating any law, making annoying or offensive calls, or interfering with other customers’ Service. You further agree not to resell, transfer, or share your service. In consideration of use of the website, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by registration forms; and (b) to maintain and update this information to keep it true, accurate, current, and complete. If any information provided by you is untrue, inaccurate, not current or incomplete,
SabaCall.com retains the right to terminate your account and refuse any and all current or future use of the services.
No refunds:SabaCall.com shall not be obligated to provide any refunds for unauthorized use or for deficiency in the quality or availability of telecommunications services. Buyer assumes all risks immediately upon purchase of the card. Prepaid cards sold are non-refundable and have no surrender value. Bankruptcy by Carrier
SabaCall.com will not be liable or responsible to reimburse for loss of minutes or loss of value in prepaid phone cards if the telecommunications carrier or distributor of the prepaid phone card declares bankruptcy.
Your completion of an online registration form constitutes an offer to purchase the Services that
SabaCall.com may accept or reject at its discretion. If
SabaCall.com accepts your registration it will notify you by email. On acceptance of your registration you will be sent a confirmation email together with dialing instructions (which will include the Access Number and electronic PIN) as well as
SabaCall.com Customer Support contact information for the Services that you have purchased. You may register for the
SabaCall.com Services at our Website at
www.SabaCall.com.
To protect against potential fraud. SabaCall.com SabaCall.com may take steps to verify the validity of the credit/debit cards information you provide to us. The verification process may include debiting an amount between .01 and .99 from your credit card account and then immediately crediting the same amount back to your credit card, as well as asking you to verify the amount debited in order to confirm that you are in possession of your credit card.
SabaCall.com will only use this process to screen for fraud and will not otherwise debit your credit/debit cards account except as part of a transaction conducted through your account for the Service. By providing
SabaCall.com with your credit/debit card information, you authorize
SabaCall.com to debit and credit your credit/debit card account for an amount less than one dollar for such verification purposes.
Payment for prepaid calling packages.Payment occurs on a prepaid basis for the amount you select when you ordered the Service, which balance is held in your account. Please note: If you have received a free offer for a specific amount, you will not be charged for the first time until after you have exhausted the amount provided in your free offer
Calling Plan Rates and Charges: You agree to pay
SabaCall.com for all Services at the rates associated with the calling plan that you selected. Payments must be in U.S. currency. The per-minute rates associated with the calling plans currently marketed by
SabaCall.com are set forth in the appropriate Calling Plan Schedule. You also agree to pay applicable Surcharges that are not taxes or otherwise required by the government to be assessed on you (“Surcharges”). Surcharges associated with particular calling plans are similarly set forth in the appropriate Calling Plan Schedule.
A surcharge per minute may apply with 800 accessed calls. In order to utilize the full amount of minutes announced on your card, all calls must be placed within the same day without disconnecting the call You agree to pay any taxes and fees that are required to be paid by the government (“Government Mandated Charges”). The Government Mandated Charges vary by state and are not set forth on
SabaCall.com website.
Auto Recharge your account feature (optional).If you elect to enable the auto recharge feature during your order process, your credit card will be automatically charged for the same prepaid package amount you selected when you ordered, on a recurring basis every time your account balance falls below USD $1.00. You can elect to disable this auto recharge feature at any time by log into our website
www.SabaCall.com . Please note, if you exhaust your account balance during your call, you may be disconnected, and must redial your call to use your additional auto recharge amounts.
No Emergency Services: You expressly agree and understand that the
SabaCall.com is not intended to support or carry emergency calls to any type of hospital, law enforcement agency, medical care unit or any other kind of Emergency Service.
SabaCall.com, its Affiliates or
SabaCall.com Staff are in no way liable for such emergency calls.
Liability: You agree that
SabaCall.com should not be responsible for any third party claims against
SabaCall.com that arise from your use of the services. Further you agree to reimburse
SabaCall.com for all cost & expenses related to the defense of any such claims, including attorneys’ fees, unless such claims are based on
SabaCall.com willful misconduct or gross negligence this provision will continue to apply after the agreement ends.
Applicable Law: This site is created and controlled by Saba Communications in the State of California, USA. As such, the laws of the State of California will govern these disclaimers, terms, and conditions, without giving effect to any principles of conflicts of laws. We reserve the right to make changes to our site and these disclaimers, terms, and conditions at any time.
